The state of Washington has agreed to change its foster parenting rules after a legal challenge over a policy that effectively excluded Christian families. The previous licensing guidelines required foster parents to affirm and support a child's gender transition, which conflicted with the religious beliefs of some applicants who do not endorse such medical or social interventions for minors.
Under a settlement reached this week, the state will no longer enforce that requirement. Instead, licensing workers will evaluate each family on a case-by-case basis, without automatically disqualifying those who hold traditional views on gender. The change means that religious families who believe children should not undergo gender transition procedures can now apply to become foster parents without being turned away solely for that reason.
The lawsuit was brought by a Christian couple who said their faith prevented them from supporting a child's gender transition. They argued the old policy violated their religious freedom rights. State officials did not admit wrongdoing but agreed to revise the rules to avoid further litigation. The settlement also requires the state to train its staff on the updated policy.
Advocates for the change say it ensures that more qualified families can care for children in need, while opponents worry it could leave some LGBTQ+ youth without affirming homes. For now, the state will focus on matching children with families based on individual needs rather than a blanket rule.
